Negotiations Update  (8/3/2010)

  • We have completed 3 full days of negotiations. Both sides have presented full proposals and we have seen very little movement from the employer.
  • We will be heading to Federal mediation and will notify you of the dates and time SOON.
  • We are working for you to keep our contract fair and to prevent takeaways.

Survey  (5/4/2010)

Your contract expires July 31, 2010. In preparation for the upcoming negotiations, you will be receiving a survey in the mail. The survey is also be posted online, linked to in the box above.

Please take the time to complete this survey, preferably online using the link above. Please complete the online survey by May 30, 2010. If you are filling out the paper copy, please have the survey postmarked by May 20, 2010. Be sure to complete the front and back of all pages of the survey.

Weingarten Rights  (1/1/2010)

Attention all Toppenish Community Hospital RNs - Know Your Weingarten Rules!
Under the Supreme Court’s Weingarten decision when an investigatory interview occurs, the following rules apply:
 
Rule One: The employee must make a clear request for union representation before or during the interview. The employee cannot be punished for making the request.
 
Rule Two: After the employee makes the request, the employer must choose among three options. The employer must either:
  • Grant the request and delay questioning until the union representative arrives and has a chance to consult privately with the employee.
  • Deny the request and end the interview immediately.
  • Give the employee a choice of either having the interview without representation or end the interview.
Rule Three: If the employer denies the request for union representation and continues to ask questions, it commits an unfair labor practice and the employee has the right to refuse to answer. The employer may not discipline the employee for such a refusal.
 
What to do if you are called into a meeting?
 
Make the following statement: If this meeting could in any way lead to my being disciplined or terminated, or affect my personal working conditions, I respectfully request that my union representative be present at this meeting. Without representation present, I choose not to participate in this discussion.

Current Issue

Short Staffing  =  No Breaks  =  Unsafe Patient Care

The issue of meal and rest breaks has plagued nurse for many years. It has never been about nurses not wanting to take their breaks.  It is about real concerns related to staffing and the ability to provide SAFE Patient Care. It is about hospitals having enough STAFF to meet the requirements of the law to provide rest breaks.

Missed meal and rest breaks have a direct relationship to short staffing which can lead to unsafe patient care.  Missed meal and rest breaks are a direct result of the lack of commitment to provide adequate staffing. Missed meal and rest breaks force you to work exhausted and lead to increased medical and medication errors, thus putting both Your Patients - and YOU - in jeopardy. 

We don’t think it is unreasonable to expect to be able to stop and rest for 15 minutes every 4 hours …  do you?

As a Registered Nurse working in Washington:

Did You Know?

  • You are entitled to an unpaid meal period of one-half (1/2) hour if you work five (5) or more hours.
  • You are entitled to one (1) fifteen minute break halfway through every four (4) hours of work.
  • You are entitled to compensation if you are required to remain on duty or in your unit during your meal period.
  • You are entitled to compensation for your missed rest breaks.
  • Short staffing results in you not getting your breaks and in unsafe patient care.

  • Filed grievances at numerous facilities on missed breaks, Settlement reached at Virginia Mason Hospital and St. Joseph Hospital in Bellingham.
  • Won Arbitration decisions on missed breaks at Sacred Heart Medical Center, Yakima Regional Medical & Heart Center.
  • Pursuing the Department of Labor & Industries to change State Regulations on missed Breaks for Nurses.

What You Can Do!

  • Follow your contract, if you miss your meal/break period, document on your time card and keep your own personal record of missed breaks.
  • Complete an ADO form and distribute to your manager with a copy to your local unit chair and your WSNA Nurse Representative
  • To file a complaint with the L & I, notify your Nurse Representative at WSNA for the paperwork and instructions.
