Negotiations Update for January 2012  (1/10/2012)

After six sessions and months of work, WSNA has elected Mediation as a means to facilitate the negotiations process.  We have agreed upon a Public Employment Relations Commission mediator and set a date to meet for February 29th.  WSNA is hopeful that UWMC administration will hear the voices of the nurses that have stood up over the last 6 months and boldly stated that "if the benefits that brought me to UWMC go away, so will I."  Several of the proposals from UWMC management could pose significant patient safety risks and disrupt the lives of the caregivers that spend the most time caring for the patients, YOU the NURSES!  Be on the lookout in the case that we have a call to action in order to show UWMC that our nurses DESERVE RESPECT!

Negotiations Update  (11/17/2011)

6th Session Completed and Still Nothing!!

There has been no movement by Administration towards finding common ground.  While your WSNA Negotiations Team has made compelling arguments, presentations, provided data and created reasonable proposals. Administration continues to stonewall progress.  WSNA does not believe that it is fiscally responsible to schedule more negotiation sessions if Administration refuses to consider our fair and equitable proposals.
       
We are seeking to move to Mediation and will provide the dates of these meetings as soon as we are able to identify them.  We will not continue to take “NO” for an answer and UWMC Administration and Management will have to wake up and see that simply doing nothing is unacceptable.  Stay tuned for updates on this process and how you can get involved in letting UWMC Administration and Management know that Nurses are the lifeline of the Hospital and the driver of the significant profits that the University Medical Center has posted for the last two years running.

2011 Flu Vaccination Notice  (11/4/2011)

Attention all UWMC Registered Nurses

At the beginning of October 2011, University of Washington Medical Center announced the roll-out of their 2011 Influenza Vaccination campaign.

Here is some information that WSNA believes you should know:
UWMC communications have indicated that the only way that you could decline a flu shot was to have a medical excuse from a provider.   We discovered that information was inaccurate and that you CAN decline this without a medical excuse.

Flu vaccinations are NOT mandatory for hospital personnel
(see pages 11 and 23 of UWMC Employee Influenza Vaccination module)

  • WSNA believes that a voluntary vaccination program is only one component of a comprehensive influenza prevention policy.  To be consistent with the updated CDC guidelines, an influenza prevention program must include a comprehensive approach – any influenza prevention program that relies solely on vaccinations (mandatory or voluntary) is inadequate. 
  • WSNA believes masking policies must follow CDC guidelines for all workers, not just those unvaccinated (currently required when within 6 feet of patients) and not be used as a retaliation or punishment for unvaccinated workers.
  • WSNA supports voluntary efforts that aim for 100% vaccination rates, including annual education and implementation of comprehensive influenza vaccination programs for all health care providers.  We believe that employers must ensure that influenza vaccines are available and offered to every health care worker annually at convenient times and locations.

UWMC Policy states that if you do not have a medical reason not to be vaccinated, you must do the following by November 11th, 2011:

  1. Complete the online education module
  2. Complete one-on-one education regarding the benefits of vaccination in order to protect UWMC patients and staff
  3. Sign a declination statement including a reason for declining the vaccine
  • WSNA believes that if a declination form is required, the employee must be able to sign the form confidentially; that is, the health care worker must not be required to divulge personal health information or declare the reason(s) for refusal of a vaccine.  The employer must not discriminate against or discipline a nurse or health care worker for opting out.

Negotiations Update  (10/21/2011)

Your WSNA Negotiating Team met for a full day on Wednesday, October 19th, 2011… little or no progress was made:  Here are the facts:

  • UWMC Administration still wants RNs to give up the 28 day/160 hour scheduling option which would change current pay practices and totally change self scheduling practices
  • UWMC Administration still wants to assign RNs to variable shift lengths of 12, 10 and 8 hour shifts solely at the discretion of management (so much for trying to plan your life around work!)
  • The September negotiations update posted by UWMC Administration was filled with gross inaccuracies regarding WSNA wage proposals
  • UWMC wages for RNs are as much as 8% behind other Seattle area hospitals at certain steps
  • UWMC Administration has expressed a disinterest in recognizing “Recognition of Experience” beyond step 28
  • UWMC Administration has expressed disinterest in extending WSNA benefits and “Just Cause” provision to per diem RNs
  • UWMC Administration has expressed lack of interest in the cash out of accumulated vacation above 240 hours (This hard earned vacation time is currently lost!)
  • WSNA Says RNs Deserve Respect  ***  Respect in Comparable Wages  ***  Respect in Retention Incentives
  • Respect in having such a contributing role in the huge financial success of UWMC.

Contract Negotiations Updated Notice  (9/29/2011)

On Wednesday, September 28th 2011, your WSNA Negotiation team of RNs met with management
for our 4th session.  While we made some advances, UWMC has offered a ZERO dollar increase for
wages for the year beginning July 1st of 2012 through June 30th of 2013.
 
Despite touting more than 50 million dollars in profits for each year for the past two years running, UWMC has shown what they consider to be the value of RNs at UWMC!!  They have also denied any increases in a number of premiums that are currently less than many of the greater Seattle Hospitals.
 
Management continues to insist on wanting to take away the 28/160 schedule option that gives the Nurses at UWMC the flexibility and input into their current scheduling.  This would significantly impact your ability to self-schedule and have the necessary involvement in the process.

Negotiations Update  (8/10/2011)

Nurses Deserve Respect!
 
On Tuesday August 9th, your WSNA Negotiation Team members met with Administration for a third time.   The University continues to withhold its economic proposal while at the same time pushes for even more drastic take-a-ways.
The University has proposed the following take-a-ways.
·         Removal of language guaranteeing nurse input into assignment of shifts and shift lengths. Management wants to be able to change the length of your shifts as often as they wish. This means that you could be forced to work any mix of 8, 10 or 12 hour shifts without having any say. Our current language requires that no change can take place without the individual nurse’s mutual agreement.
·         Low Census – you go home! Instead of staffing to meet demand, management wants to just send you home for the day. To get paid for missed work hours, you would have to utilize vacation, sick leave, or other accounts just to make sure you get paid. If you have no available leave, then no pay for the lost hours.
·         Dramatic changes in the way that you are paid. Hour for hour pay checks rather than salaried – an end to fair, equitable, predictable paychecks. RNs working shifts where worked hours differ between weeks or pay periods would see great fluctuations in the amounts of their bi-monthly paycheck. How might this affect your budget? How might this affect your automatic deductions for mortgage, etc.?
·         Forced Mandatory Call for all RNs working in the Emergency Department and Labor & Delivery. This proposal was made with no tangible proof of need and no parameters of how many days per month a nurse might be obligated to take this Mandatory On-Call.
Mandatory Call is no substitute for and should NEVER be used to make up for core staffing shortages!!
·         Lost Overtime – To avoid overtime, management could just low census a nurse one day and assign additional hours to another.
·         There are more take-a-ways proposed! Attend the meeting below for additional information.
 
UWMC continues to refuse to provide a Wage Opener in response to the original WSNA Proposal of July 6, 2011. While there is the assumption that both parties continue to bargain in good faith, UWMC has elected to drag their feet on Economics in violation of the agreed upon ground rules.  WSNA continues to be patient, but the University must come to the table at the next date with its full proposal.
 
Our Next Negotiating Session is set for September 28th.
WSNA Negotiation Team Members along with WSNA Nurse Representative Ed Zercher will be available for your questions and clarification of issues from 7am-3pm this Friday, August 12th in the rear of the Cafeteria.
 
All Nurses should show up for our Local Unit Meeting on Tuesday August 30th in Cafeteria Conference Room “B” from 1pm-3pm or 6pm-8pm.  We will have Negotiation Updates and work to let you know how your involvement in WSNA makes a difference.  There will be Free Drawings and the opportunity to speak with your WSNA Local Unit Officers and Negotiation Team Members.

WSNA Negotiations Update  (8/4/2011)

UWMC Registered Nurses be warned that your WSNA negotiating team has met with UWMC Administration for a second time and your working conditions and benefits are being severely threatened
 
WSNA has presented a fair and reasonable opening proposal while your management is insisting on drastic changes to your current working conditions by proposing the following:
  • Forced Mandatory Low Census… this would no longer be voluntary and your bi-weekly paychecks could be greatly impacted in times of low patient volume
  • Elimination of self-scheduling…this is suggested as part of the Kronos Electronic timekeeping implementation
  • Elimination of the 28 day 160 hour work week option- All nurses would become hourly and pay checks would no longer be one half of the estimated monthly salary but, rather, directly reflect the hours worked in the two week pay period.  With this proposal, all nurses would have to choose 40 hours in 7 days or 80 hours in 14 day schedules.  This change could also mean elimination in overtime for additional hours worked beyond your regularly scheduled shift
  • Increase in notification requirement for Sick Call for days from 1 hour to 2 hours
  • A complete change in the requirements to attain Rest between Shifts pay.  RNs working 8 hour shifts will be expected to work two hours longer without being compensated while the hours of compensation will decrease from a current minimum of 8 hours at time plus one half to as little as a half an hour!  As part of their proposal, hours worked from Call back, standby, education and committee meetings would not apply towards attaining this Rest Between Shifts premium.
The above items only represent a portion of the potential take-aways and cut backs that UWMC (boasting over $50,000,000 – fifty million dollars - in profits for each of the last two years) has elected to dump on the shoulders of their nurses.
 
Where is the Disconnect?
The very reasons that you have chosen to work at UWMC are the same items that UWMC has chosen to eliminate.  Your rights, working conditions and long standing benefits are at risk.
UWMC Administration has stated a desire to mimic what they consider to be “Community Standards” and in doing so propose outlandish take-aways for Registered Nurses working there.
 
The time is now for Solidarity
This means showing management that all nurses share the same interests in preserving these benefits. 
It is time for Nurses to ask themselves “What Can I Do to Make a Difference?”
 
We need to let them know this by standing behind your Negotiation team Nurses and WSNA. Talk about these issues during your breaks and on your lunch periods.  Support your colleagues and WSNA by wearing your WSNA buttons, wristbands and lanyards.  Wear WSNA blue on every day that your Negotiating Team is at the table.

WSNA will not allow your rights to be stripped away!
Now is the time to speak up!

Congratulations to all UWMC Surgical Services RNs!  (1/18/2011)

As part of an ongoing grievance concerning the use of Compensatory Time in Surgical Services, WSNA and UWMC have reached a settlement agreement that includes the following:

"Effective January 1, 2011, the parties have agreed nurses in Surgical Services shall be permitted to use compensatory time for personal time or vacations in increments of no less than eight (8) hours to a maximum of sixteen (16) hours per calendar year, subject to unit guidelines and the collective bargaining agreement."  Management has developed unit guidelines that will be part of this process.

WSNA believes that RNs in Surgical Services should have the flexibility to use this Compensatory time in a way that suits them best.  This is a huge step in allowing those nurses that sacrifice their time working extra to receive that time back in return.
I want to send a huge thanks to our WSNA Local Unit Officers and those RNs working in O.R. and PACU who assisted in making this happen!

Rest Breaks Update  (11/12/2010)

On October 28th, representatives from WSNA met with a UWMC management selected “Rest Break” team for a second time to discuss the implementation of our August 2010 Rest Break Arbitration award.

During this meeting, we reviewed the existing UWMC policy surrounding Rest Breaks and insisted that the policy be consistent with the arbitration award.

Here are some key changes made:

  • The policy statement that “each employee is responsible for planning and taking appropriate rest and meal periods during his or her work shift” should be deleted.  WSNA believes, and the arbitration award supports, that it is the Hospital’s responsibility to ensure your rest breaks and it should do so in a collaborative fashion with the Professional Nurse.
  • The statement that “If an employee would like to divide up their break into smaller increments of time, they may, but solid breaks are encouraged when possible” should be deleted.The arbitration award clearly states that interrupted breaks will count as no break at all.

UWMC asserts that they reserve the right to continue to utilize the “Missed Rest Period/Meal Period Form” in addition to any new form while WSNA maintains that the old forms are obsolete, redundant and cumbersome.  A staff nurse from 7SE described these forms as “intimidating.”  WSNA is opposed to this dual-form system!

Nurse and patient safety remain our number one goals and WSNA believes that simply adding layers to an already intrusive form will do nothing to ensure that UWMC RNs are provided necessary rest breaks.

It is only when UWMC management is willing to take a hard look at staffing levels and begins to make necessary changes that a real commitment will be realized.
As a result of discussions at our October 28th meeting, WSNA has insisted that UWMC stop any type of “pilot program” on 7NE and 8NE until we are in mutual agreement (and or receive arbitrator direction) on the Rest Break Tracking form, date of implementation, etc.

Your continued assistance in providing updates and communication is crucial in getting UWMC to finally commit to providing appropriate breaks for all RNs at UWMC.  Please contact Ed Zercher, WSNA Nurse Representative at ezercher@wsna.org with any updates or questions that you may have on this issue.

"Got Break?"  (8/27/2010)

If not, you should!   A recent Arbitration decision agrees with what WSNA has been arguing for years:

  • Every RN is entitled to an uninterrupted, 15 minute break for every 4 hours worked.
  • Intermittent breaks are not sufficient to give a nurse the rest needed to provide safe and effective patient care.
  • If your break is interrupted, your 15 minutes will start over from the beginning.
  • The responsibility to arrange for and ensure breaks is now the responsibility of the Hospital - not the nurse!
  • Time spent briefing a break partner and being briefed upon return does not count as part of your break.
  • If UWMC fails to comply with the rest break provision of our Collective Bargaining Agreement, it could lead to serious financial disincentives.

Arbitrator Howell Lankford made it very clear in his decision that UWMC has not only violated our contract, but has instead chosen to ignore the scope and intensity of this important patient and nurse safety issue.

Demand your breaks!  Let’s change the “No Break” culture here at UWMC!

Rest Break Arbitration Victory  (8/10/2010)

UWMC Registered Nurses Unite for Patient and Nurse Safety!

As many of you know, WSNA nurses at UWMC took a stand to fight for uninterrupted 15 minute rest breaks during which nurses are completely relieved of their duties. Article 7 of the WSNA-UWMC agreement guarantees 15 minute rest breaks, but Hospital management has done little to make those breaks a reality. In response to a grievance challenging management's failure to provide breaks, the Hospital claimed that nurses were getting their breaks. The grievance was submitted for final and binding arbitration to Arbitrator Lankford who ruled that:

  1. The UWMC did violate Article 7 of the agreement by failing to provide 15 minute rest breaks to RNs;
  2. Rest breaks are essential for the health of nurses and patients;
  3. The contract requires full fifteen minute block breaks, not intermittent breaks; if a break is interrupted for any reason, a nurse is entitled to another full fifteen minute break;
  4. Arbitrator Lankford rejected the Hospital's claim that it is the nurse's responsibility to assure they get their breaks; and
  5. He rejected the Hospital's claim that in-unit staffing procedures relieved it of responsibility to provide breaks.

His ruling speaks loud and clear it is the Hospital's obligation to provide 15 minute rest breaks and its failure to do so violates the Agreement! As a remedy:

  1. He directs the Hospital to provide uninterrupted rest breaks;
  2. He directs the Hospital to set up a system to track missed rest breaks which will count breaks as missed unless the RN acknowledges receiving the break; and
  3. Although for now he has not awarded pay for missed breaks, he has ordered breaks be given, missed breaks recorded, and warned the Hospital in no uncertain terms that unless the Hospital starts providing breaks, dire consequences will follow.

Negotiated Contract Extension Vote  (7/5/2010)

Your WSNA Negotiating Team and UWMC Administration met on July 13. Upon meeting and discussing the current economic realities of the times, your WSNA negotiating team and the UWMC management team agreed to extend the current contract by one year. The extension means that the current contract between WSNA and UWMC will remain the same for the next year, including your 2.5% raise that will go into effect in Jan. 2011 and continued step increases in accordance with years of service. The extension successfully avoids any take-a-ways and provides for full negotiations to begin in 2011 for the next contract.

The MOU (Memorandum of Understanding) containing the contract extension is scheduled for a vote on August 5, 2010. Your vote is important and all WSNA members in good standing are encouraged to show up and vote for this MOU. Negotiating team members as well as the WSNA attorney will be on hand to answer all of your questions and address your concerns.
