Buprenorphine Update for ARNPs

The Comprehensive Addiction and Recovery Act, signed into law on July 22, 2016, expanded the privilege of prescribing buprenorphine in office-based settings to qualifying Advanced Practice Registered Nurses (APRNs) through October 1, 2021.

The US Office of Management and Budget (OMB) must approve the ability for APRNs to complete a waiver notification form and receive a special identification number from the Drug Enforcement Agency (DEA), which is still in progress.

In order for an ARNP to obtain the waiver to prescribe buprenorphine, as authorized in the 2016 Comprehensive Addiction and Recovery Act (CARA), the US Office and Budget (OMB) must approve the ability for ARNPs to complete a waiver notification form and receive a special identification number from the DEA. The OMB is still working on these processes. Regulation must be written by the Department of Health and Human Services. There is also a question as to whether these regulations fall under the regulatory freeze memorandum signed by President Trump on January 20, 2017. Therefore, even if the ARNP has the required training, the waiver cannot be dispensed at this time.
