On January 1, 2018, WSNA filed a grievance alleged the employer violated article 5.10 of the collective bargaining agreement, on behalf of Robert Blanchard, an RN in the Cath Lab. The grievance challenged the hospital’s refusal to pay overtime to a nurse picking up an overtime shift if that nurse worked an RBS (rest between shift) shift earlier in the same week. The hospital claimed that paying overtime and RBS in the same week would amount to pyramiding, even though the premiums were earned on different shifts.

Following a hearing before an arbitrator, the hospital has agreed to change its pay practice. From now on, hours worked on RBS will be counted as hours worked for the purpose of calculating overtime. Congratulations to Robert Blanchard and Local Unit Grievance Officer Joan Guercia for bringing this case forward and achieving this victory for all nurses at Kadlac.
