Update on Article 9.2 – Work on Day Off

The Employer notified WSNA and the local Officers during the May Conference Committee meeting that they were experiencing concerns with the application of Article 9.2 (Work on Day Off) for nurses who voluntarily sign up for open shifts after the schedule has been posted. Management stated that their understanding of the language was that the premium pay applies only when the Employer specifically requests or calls upon a nurse to work on their scheduled day off, not when a nurse independently volunteers for an available shift.
The parties continued discussions regarding this issue during a meeting in June called by HR and the CNO. Despite those discussions, on Friday, July 17, 2026, Human Resources notified WSNA of the Employer's position that, effective July 19, 2026, nurses who sign up for open shifts on their days off would no longer receive the Article 9.2 premium. Under the Employer's interpretation, the premium will only be paid when the Employer directly contacts or requests a nurse to work on their day off.
WSNA disagrees with the Employer's unilateral change in the application of this contractual provision. Accordingly, WSNA has submitted a Cease and Desist Demand, filed a grievance, and submitted a Request for Information (RFI). This grievance has been filed as an "All Affected" grievance on behalf of all impacted bargaining unit nurses.
Any nurse who wishes to attend grievance meetings regarding this matter may do so. We will continue to keep members informed as the grievance process moves forward and additional information becomes available.
