You may have recently received infor­ma­tion (“Notice of Class and Collec­tive Action Settle­ment”) regarding the settle­ment of a class and collec­tive action lawsuit, the Etchev­erry v. Franciscan Health System case. You should review the infor­ma­tion thoroughly.

Unless you are planning to file your own lawsuit concerning the same issues, there is no reason not to partic­i­pate in the settle­ment in the case.

Please note that WSNA is not a party or other­wise involved in that case.

The lawsuit and settle­ment vindi­cate your rights under state and federal law. While WSNA is not involved in the case, WSNA does not oppose it.

The settle­ment consists of two parts. Note that if you qualify to partic­i­pate in the second portion of the settle­ment (the collec­tive action” part related to the federal Fair Labor Standards Act), you must opt in by submit­ting a FLSA Collec­tive Consent Form no later than September 27, 2021.
